Agreeing to these terms

These terms govern your use of govbrain.org and the GovBrain application (together, the “service”). By using the service, you agree to them. If you use the service for a firm or other organization, you confirm that you can accept these terms on its behalf, and “you” includes that organization. If your organization has signed a separate agreement with GovBrain, that agreement controls where it conflicts with these terms.

Your account

You need an account to use the application. Give accurate information, keep your sign-in methods secure and do not share your account. Multi-factor authentication is required. You are responsible for activity under your account, and you must tell us promptly at hello@govbrain.org if you suspect unauthorized use. Team owners and admins decide who belongs to their team.

Your content

“Customer content” means the information you and your team add to the service, including what partners submit through your upload links. You keep all rights to your customer content. You give GovBrain permission to host, copy, process, transmit and display it only as needed to provide, secure and support the service for you, including processing by the service providers listed in our Privacy Policy.

You confirm that you have the rights and permissions needed to add your customer content, including any personal information about your Personnel and partners.

Sensitive information. The service is not designed for classified information, Controlled Unclassified Information (CUI) or export-controlled data. Do not add that kind of information unless we have agreed to it in writing.

AI features

Some features use artificial intelligence to analyze solicitations, recommend Personnel and projects, and draft or edit content. AI output can be inaccurate or incomplete. You are responsible for reviewing it, and for everything you submit to an agency or anyone else. GovBrain does not guarantee that a proposal will meet a solicitation’s requirements or that you will win an award.

Opportunity data

The service includes information about federal contract opportunities from public sources such as SAM.gov. We do not control those sources, and the information may be incomplete, out of date or changed after we show it. Always confirm details, including due dates and amendments, against the official notice. GovBrain is not affiliated with SAM.gov, PIEE or any U.S. government agency.

Acceptable use

Do not use the service to:

  • break any law or regulation, or infringe anyone’s rights;
  • access or try to access another team’s data, or probe, test or bypass our security without our written permission;
  • upload malware, or interfere with the service or its other users;
  • copy, scrape, resell or reverse engineer the service, except where the law allows it; or
  • send spam or misleading messages, including through partner upload links.

If you find a security vulnerability, please report it as described on our Security page.

Our service and rights

GovBrain and its licensors own the service, including the software, the website and our trademarks. Subject to these terms, we give you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes. If you send us feedback, we may use it without any obligation to you.

Fees

Paid features are governed by the order, quote or subscription terms you accept, which set out the fees and billing.

Suspension and ending use

You can stop using the service at any time. We may suspend or end your access if you break these terms, if your use creates a security risk or legal exposure, or if we stop offering the service. Where it is reasonable to do so, we will give you notice first. After your access ends, we will handle your customer content as described in our Privacy Policy.

Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, GovBrain disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the service will be uninterrupted, error-free or accurate.

Limitation of liability

To the extent the law allows, GovBrain will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, including contracts not awarded. GovBrain’s total liability for any claim relating to the service is limited to the greater of the amount you paid us for the service in the 12 months before the claim and US$100.

Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page. If a change is significant, we will tell account holders before it takes effect. If you keep using the service after a change takes effect, you accept the updated terms.
